Terms & Conditions
Please read these terms carefully before using Drivehelp, especially Section 3 on driving safety, Section 8 on credits and Section 11 on community content.
Welcome to Drivehelp! These Terms and Conditions govern your use of the Drivehelp mobile application ("Drivehelp" or the "App") and its related services published by Big-Me Softwares ("we," "us," or "our"). By downloading or using the App, you agree to be bound by these terms.
1. Acceptance of Terms
By installing and using Drivehelp, you confirm that you are at least 13 years of age and agree to these Terms and Conditions in full. If you use the App while driving, you also confirm that you hold a valid driver's license where you drive. The community features (Section 11) are for drivers: to use them, you must be old enough to drive where you live. If you do not agree with any part of these terms, please do not use the App.
2. About Drivehelp
Drivehelp is an iOS "drive buddy" application that allows users to:
- See their GPS speed on a large, color-changing speedometer, along with top speed, time, date and outside temperature
- Set their own maximum speed and receive chime and spoken alerts (voiced by "Emma") when they exceed it, plus fixed warnings at 95 mph and 100 mph
- Use a mirrored windshield heads-up display ("HUD") mode
- See a Google map, and get turn-by-turn directions with live traffic, place search and "Take me somewhere" using credits, or open directions in a maps app
- Track an estimated fuel level and range for one or more cars, log fill-ups and see fuel spending
- Hear low-fuel warnings and gas station callouts
- Automatically record trips with route, distance, duration, speeds and driving events
- Receive drowsiness alerts, break reminders and spoken check-ins
- Keep saved places with photos, voice memos and notes, share them with people they choose, set up routines, and move their data to a new phone with an export file
- Optionally share and see road reports, talk with drivers nearby and share anonymous speeds ("community features")
- Optionally sign in and buy Drivehelp Packs of credits for the AI, voice, places and directions features ("credit features")
- Optionally connect their own services as developer connectors
The core features work without an account or credits.
3. Driving Safety — Important
Drivehelp is a driving aid, not a substitute for safe, attentive driving. You are always fully responsible for how you drive, for watching the road, and for obeying all traffic laws.
3.1 Obey All Traffic Laws and Posted Limits
You must obey all traffic laws and posted speed limits at all times. The maximum speed you set in Drivehelp is your personal preference only; it is not the legal speed limit, and Drivehelp does not know the posted speed limit of the road you are on. The absence of an alert never means that your speed is legal or safe for the conditions.
3.2 Set Up Before You Drive
Set up the App, including signing in, buying packs, your settings, cars, saved places, routines, trip plans, community settings, connectors and phone position, before you start driving. Do not look at, type on, or handle your phone while driving. Don't use any of the App's features, including road reports, Talk and connectors, when it isn't safe to do so. Use voice features only where hands-free phone use is legal and only when it is safe, or let a passenger operate the App.
3.3 Mount and Position Your Phone Legally and Safely
You are responsible for mounting or placing your phone in a way that is legal where you drive, is secure, and does not block your view of the road, mirrors, instruments or airbags. Laws about phone mounts, items on the dashboard and windshield displays vary, and use of HUD mode may be restricted in some places. Check and follow your local laws. A phone lying on the dashboard can slide or become a projectile; secure it appropriately.
3.4 Drowsiness Detection and Break Reminders
Drowsiness detection, break reminders and check-ins are convenience features, not medical or safety devices. They will not detect every sign of fatigue and may not work when the phone isn't facing you, in poor lighting, with sunglasses, or for other reasons. Never rely on Drivehelp to keep you awake. If you feel tired, stop driving and rest somewhere safe.
3.5 Directions and Community Information Can Be Wrong
Directions, traffic, road reports, messages from other drivers and crowd traffic can be wrong, incomplete or out of date. Never rely on them over what you see on the road. Always obey traffic laws, road signs and posted limits, whatever the App, a report or a message says.
4. Accuracy of Information
Information shown or spoken by Drivehelp is approximate and is not guaranteed to be accurate, complete or current. In particular:
- Speed is estimated from GPS and can lag, jump or be wrong, especially in tunnels, cities, under bridges or with a weak signal. Your vehicle's speedometer takes precedence.
- Fuel level and range are estimates based on your inputs, GPS distance and the tank size and MPG you enter. Actual fuel use varies with driving style, load, terrain and weather.
- Gas station and place information (location, brand, membership requirement, opening hours, ratings, prices and availability) comes from map data and may be wrong or out of date. A place picked by "Take me somewhere" may be closed or not what you expected.
- Routes and traffic come from Google and may be wrong, unsafe or out of date.
- Community information (road reports, Talk messages and crowd traffic) is provided by other drivers and may be wrong, misleading or outdated.
- Temperature, weather, trip statistics, driving events and spending totals are approximate.
- Drowsiness detection is not guaranteed to detect drowsiness and may give false alerts.
5. No Responsibility for Driving Outcomes
To the maximum extent permitted by applicable law, Big-Me Softwares is not responsible for:
- Speeding tickets, fines, penalty points, license suspension or revocation, or insurance consequences
- Accidents, injury, death or damage to property
- Running out of fuel, or any decision you make based on the App's fuel or range estimate
- Routes, directions, closures or traffic information, whether shown in the App or in Google Maps, Apple Maps, Waze or any other app
- Gas stations or places that are closed, require a membership, or are not where the map data says they are
- Road reports, messages or crowd traffic from other drivers, or decisions you make based on them
- Alerts that are missed, late or not heard, for example because of volume, Bluetooth or CarPlay settings, permissions, a weak GPS signal, or the device's battery or background limits
6. Purchase & Licensing
Drivehelp is distributed through the Apple App Store. Any price or purchase, including Drivehelp Packs, is handled by Apple and shown in the App Store.
You are granted a personal, non-exclusive, non-transferable license to use the App on Apple devices associated with your Apple ID, subject to Apple's App Store Terms of Service.
7. Accounts
- An account is needed only for credits: buying Drivehelp Packs and using credit features. You create one with Sign in with Apple or Sign in with Google.
- One account per person. Don't share your account, and don't create extra accounts, for example to get more free welcome credits.
- Keep your Apple or Google sign-in secure. You are responsible for activity on your account. Tell us right away if you think someone else is using it.
- You can delete your account at any time in Settings → Account → Delete my account, or by contacting us. Deleting your account deletes its remaining credits, which can't be restored or refunded by us. Apple refunds are handled by Apple (Section 8).
- We may suspend or close an account that breaks these Terms (Section 9).
8. Drivehelp Packs & Credits
- What you buy. Drivehelp Packs are one-time, consumable In-App Purchases of credits. There is no subscription. Credits are used by the credit features: the voice co-pilot, photo reading, trip planning, "Take me somewhere", natural voices and transcription, Google places, search and directions, and the co-pilot's use of connectors. New accounts may get a few free welcome credits, limited to one set per device.
- A limited license, not money. Credits are a limited, non-transferable license to use credit features in the App. They are not currency or property, have no cash value, can't be exchanged for money, and can't be sold, transferred or moved to another account.
- No expiry. Credits don't expire. They are tied to your account and come back on a new phone when you sign in with the same account.
- Refunds. Refunds are handled by Apple under its own policies. If Apple refunds a purchase, the credits from that purchase are removed from your account.
- Prices. Prices are set by country, shown in the App Store, and may change. A price change doesn't affect credits you've already bought.
- How many credits a feature uses. Each use of a credit feature deducts credits based on the work it takes. We may change how many credits a feature uses, for example when provider costs change. The current usage is shown in the App.
- Availability. Credit features depend on our server and on third-party providers, and may sometimes be slow, limited or unavailable. We may add, change or remove credit features over time.
9. Fair Use & Anti-Abuse
Credit features and our server are for your personal use through the App. You agree not to:
- Access our server other than through the App, or use scripts, bots or automation against it
- Resell, share or redistribute credit features or their output as a service
- Try to get free or extra credits through multiple accounts, device tricks, fraud or refund abuse
- Probe, overload or interfere with our server, or get around its rate limits or safeguards
- Use credit features to create content that breaks the law or the providers' usage policies
We may apply rate limits, and may suspend accounts, remove credits obtained through fraud or abuse, or block access, when we reasonably believe these rules have been broken.
10. Third-Party AI, Map & Other Providers
10.1 Providers
Credit features use third-party providers: Anthropic (Claude), OpenAI and Google (Maps, Routes and Places). Our server sends your requests to them under Drivehelp's business account. The map in the App is Google Maps. The App also relies on services such as Apple MapKit, Apple and Google sign-in, Apple In-App Purchase, Open-Meteo, and the Google Maps, Apple Maps and Waze apps. We do not control these services. Their availability and accuracy are not guaranteed, and they are provided under their own terms, including Anthropic's, OpenAI's and Google's, and Google Maps' Additional Terms of Service.
10.2 AI Output May Be Wrong
AI-generated output, including fuel readings from photos, answers from the voice co-pilot, trip plans, stop suggestions, place picks, message summaries and trip summaries, may be inaccurate, incomplete or inappropriate. Do not rely on it for safety-critical decisions. Check important information yourself.
10.3 "Take Me Somewhere" Is Not Professional Advice
"Take me somewhere" suggests places based on what you tell it, including how you feel. It is not medical, mental-health or crisis support. If someone mentions self-harm, Drivehelp shows crisis line numbers first. If you or someone else is in danger, contact your local emergency number right away.
11. Community Features & User Content
Road reports and Talk with drivers nearby let you post content ("User Content") that other drivers see and hear. These features are optional and off until you turn them on in setup or in Settings → Community.
11.1 Zero Tolerance for Objectionable Content
We have zero tolerance for objectionable content and abusive users. When you post a road report or message, you must not post or send:
- Objectionable, abusive, hateful, threatening, violent or sexual content
- Harassment, bullying or content that targets a person or group
- Doxxing or any personal information, about yourself or anyone else (such as names, addresses, phone numbers, license plates or descriptions that identify someone)
- Spam, advertising, links or phone numbers
- Content that is illegal, or that encourages dangerous or illegal driving
- False or misleading reports. Reports must be honest: only report what you actually see, and answer "Is it still there?" truthfully.
11.2 How We Enforce These Rules
- Messages are automatically filtered, and messages with profanity, slurs, links or phone numbers are rejected.
- You can report or block any message (swipe the message). A message is hidden after it is reported by other drivers, and a sender whose messages are repeatedly hidden is paused from sending.
- We may filter, hide or remove any User Content, and pause or block any sender, at any time and without notice, if we believe it breaks these Terms or harms other users.
- You can also report objectionable content or an abusive user to us by phone at +1 (469) 345-1412 or by email at abovealltheselove@gmail.com. We review reports and aim to respond within 24 hours.
11.3 Your Responsibility
You are responsible for the User Content you post. By posting, you allow us to store it and show it to other drivers as described in our Privacy Policy, for the short time it is kept. User Content reflects the views of the person who posted it, not ours, and we do not check it before it is shown.
12. Developer Connectors
Connectors let you connect your own HTTPS service so the co-pilot can use it (see the developer guide). Connectors are optional, and the co-pilot's part uses credits.
- Connectors are your own responsibility. The service behind a connector is a third-party service that we do not run, control or check. Connector calls go directly from your phone to that service.
- You are responsible for any charges from that service, and for any orders, purchases or other actions placed through it, including those you approve in the App.
- Only connect services you trust and are allowed to use, and keep your connector tokens secret.
13. Your Data & Moving Phones
Your trips, places, routines and other drive data are stored only on your device. We don't hold them, so we can't back them up, restore them or move them for you. Keeping them is your responsibility: use Settings → Move to a new phone to export a backup file and import it on a new phone, and keep that file safe. We are not responsible for data lost when a device is lost, reset or replaced, or when the App is deleted. Your credits are held in your account and come back when you sign in.
14. Privacy & Data
Drivehelp stores your drive data locally on your device. Our server holds your account and billing records if you sign in, passes credit-feature requests to providers without storing their content, and keeps community posts for a short time if you use community features. Please review our Privacy Policy for full details.
15. Permissions
The App may request the following device permissions:
- Location (While Using, optionally Always): to measure speed, record trips, estimate fuel range, find gas stations and places, give directions, follow trip plans and routines, keep alerts working in the background, detect when a drive starts, and place your road reports and messages if you use community features
- Motion & Fitness: to confirm you're in a car before the "I noticed you're driving" notification
- Camera & Photos: for fuel-gauge and receipt photos, car and saved-place photos, and drowsiness detection
- Microphone & Speech Recognition: for voice requests to the co-pilot, Talk messages and saved-place voice memos
- Notifications: for drive detection, routines and reminders
You may revoke permissions at any time via iPhone Settings, though doing so will limit app functionality.
16. Acceptable Use
You agree not to:
- Use the App in a way that breaks any law, including traffic laws and laws about phone use while driving
- Use the App to encourage or coordinate street racing, speed contests or other dangerous driving
- Interact with the App while driving in a way that takes your attention from the road
- Post User Content that breaks Section 11
- Break the fair use rules in Section 9
- Share saved places that include other people's personal information, photos or voices without their permission
- Interfere with, overload or misuse the community server, or try to get around its filters, rate limits or pauses
- Copy, modify, distribute, sell or reverse-engineer the App, except as permitted by law
17. Intellectual Property
The App, including its design, graphics, animations, code, recorded voice clips and all assets (excluding your content), is the property of Big-Me Softwares and is protected by intellectual property laws. Emma's voice clips were generated with the open-source Kokoro text-to-speech model; open-source components remain subject to their own licenses. You may not copy, modify, distribute, or reverse-engineer any part of the App.
You retain ownership of your own content, such as car photos, saved places, photos and voice memos, your trip and fuel data, and the reports and messages you post.
18. Disclaimer of Warranties
The App and its services, including credit features and community features, are provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. Big-Me Softwares does not warrant that the App or its services will be error-free, uninterrupted, accurate, or meet your specific requirements.
19. Limitation of Liability
To the maximum extent permitted by applicable law, Big-Me Softwares shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including damages arising from driving, traffic violations, accidents, fuel estimates, routes and map data, third-party AI or map providers, content posted by other drivers, lost device data, or connectors and the services behind them, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the App and for Drivehelp Packs in the 12 months before the claim.
Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above may not apply to you.
20. Updates & Changes
We reserve the right to update the App and these Terms at any time. Continued use of the App after changes constitutes your acceptance of the updated Terms. We will update the "Last Updated" date at the top of this page when changes are made.
21. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration.
22. App Store Terms
Your use of Drivehelp, including In-App Purchases, is also subject to Apple's App Store Terms of Service. In the event of conflict between Apple's terms and these Terms, Apple's terms shall prevail with respect to App Store matters.
